1. Acceptance of Terms

By accessing or using AI Prompt Generator ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

AI Prompt Generator is a SaaS platform that provides AI prompt generation and optimization tools for text and image AI models including ChatGPT, Claude, Gemini, Midjourney, DALL·E, and Stable Diffusion.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized access

4. Subscription Plans & Billing

4.1 Plan Tiers

• Free Plan: 5 prompts per day (text + image combined)
• Pro Plan: $9/month - Unlimited text prompts + 200 image credits/month
• Team Plan: $19/month - Unlimited text prompts + 1000 image credits/month

4.2 Payment Terms

Subscriptions are billed monthly in advance. Payment is processed via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.3 Automatic Renewal

Subscriptions automatically renew each month unless canceled at least 24 hours before the renewal date. Image credits reset monthly and do not roll over.

4.4 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate harmful, illegal, or abusive content
• Attempt to reverse engineer or hack the Service
• Share account credentials with unauthorized users
• Use automated systems to abuse the Service

6. Intellectual Property

6.1 Service Content

The Service, including its original content, features, and functionality, is owned by AI Prompt Generator and is protected by copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content

You retain ownership of prompts you create using the Service. We do not claim ownership of your generated content. You grant us a limited license to store and display your content as necessary to provide the Service.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. The Service may be unavailable during maintenance, updates, or due to factors beyond our control. We are not liable for any damages resulting from service interruptions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI PROMPT GENERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or other reasons at our sole discretion. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of California.
